　　甲方： Party A: 乙方： Party B:

　　本合同由 (以下簡稱甲方)同 (以下簡稱乙方)本著互惠互利、平等自愿的原則，共同協(xié)商簽署。

　　The Party A and Party B hereby mutually agree, Party A rents the van of Buick GL8 ( )which is owned by Party B. The lease term commence from the 1st of May 9th 2012 to May 8th 2013. The monthly rental of RMB13, 000 shall be paid by Party A with the official tax invoice offered by Party B.

　　經(jīng)甲乙雙方同意，甲方租用乙方和其所有權(quán)的Buick GL8 轎車(第二輛，車號(hào)0220)。租用期自2012年5月9日起，至2013年5月8日止。租用期間甲方將在收到乙方提供的正式稅務(wù)發(fā)票之后按每月人民幣壹萬叁仟元的租金支付給乙方。

　　During the lease term, both parties are pursuant to the terms and conditions of this Agreement, as follows:

　　合同期內(nèi)，甲乙雙方認(rèn)真履行此合同所規(guī)定只責(zé)任，如下：

　　1. Party A shall pay the rental before or on the 31st day of each month to Party B;

　　甲方于每月31日前支付租車費(fèi)用給乙方;

　　2. Part B’driver is working from each Monday to Friday: 8:00 am to 17:00 pm.

　　With a hour’s break at noon; Party A shall notify Party B in advance if Party A needs to use the van on Saturday or Sunday and pay OT payment at 30 RMB per hour; holiday OT can be 40 RMB per hour. The overtime payment of the driver will be made upon Party A’s confirmation with the tax invoice issued by Party B in 30 days.

　　乙方的司機(jī)在合同期內(nèi)的工作時(shí)間為每周一至周五，早八點(diǎn)至晚五點(diǎn)中午午休一小時(shí);周六、周日用車提前與司機(jī)聯(lián)系。甲方根據(jù)甲方人員確認(rèn)的簽字以月為單位支付給司機(jī)30元/小時(shí)的加班費(fèi)，法定節(jié)假日加班費(fèi)為40元/小時(shí).乙方根據(jù)甲方確認(rèn)好的加班明細(xì)向甲方開具正式發(fā)票，甲方在收到發(fā)票后30天內(nèi)付款;

　　3. Party B shall keep the interior and exterior of the van are thoroughly cleaned and

　　ensure that it is in good working condition;

　　乙方要保持車輛內(nèi)外干凈、整潔，保持車輛的正常使用;

　　4. All the maintenance related to the van and the insurance fee and other tax shall be

　　borne by Party B ;

　　乙方自行負(fù)擔(dān)有關(guān)車輛的維修保養(yǎng)及所有的保險(xiǎn)費(fèi)、養(yǎng)路費(fèi)、稅等; 5. The gasoline costs shall be borne by Party A upon production of receipts;

　　甲方根據(jù)實(shí)際發(fā)生的燃油費(fèi)用，依據(jù)發(fā)票向乙方付費(fèi);

　　6. The toll fee and parking fee shall be borne by Party A ;

　　過路費(fèi)及停車費(fèi)由甲方承擔(dān);

　　7. The van will be kept at the renter house in the off hours;

　　所租賃車輛可以在業(yè)余時(shí)間停放在租賃者家中;

　　8. Party B shall be responsible for the personal medical insurance;

　　乙方有關(guān)的個(gè)人醫(yī)療及人身傷害費(fèi)用，甲方不予承擔(dān);

　　9. In case Party B’s driver take sick leave or could not ensure the safety of driving,

　　Party B shall find a substitute till Party A satisfied and will bear all related costs; 乙方司機(jī)如遇身體不適或其他不能安全駕駛車輛時(shí)，乙方應(yīng)負(fù)責(zé)找到甲方滿意的司機(jī)代替，所發(fā)生的費(fèi)用由乙方承擔(dān);

　　10. Party A shall provide the convenience to Party B if the van is requested to be

　　properly fixed, maintained and regular checked;

　　乙方車輛如有必要修理、保養(yǎng)、年檢，甲方應(yīng)提供方便;

　　11. If any early termination occurs, one month prior written notice is requested;

　　合同雙方的任意一方提前解除此合同，必須提前一個(gè)月書面通知另一方; 12. This agreement will be extended upon the expiry date and the confirmation

　　from both parties;

　　本合同屆滿時(shí)，如雙方無爭議本合同自動(dòng)順延;

　　13. Party B shall get and keep the insurance of personal injury and possession to

　　ensure that Party A is not responsible for any issues which are caused by this van and is not responsible for any compensation caused by the van;

　　乙方須取得和維持充分的人身傷害險(xiǎn)，第三者責(zé)任險(xiǎn)，財(cái)產(chǎn)保險(xiǎn)，從而充分保證甲方免受與車輛及相關(guān)事務(wù)引起的損失或損害。甲方不承擔(dān)車輛造成的一切損害賠償。

　　14. If Party B could not obey the statement and obligation in this agreement, and

　　fail to do the rectification upon Party A’s notification, Party A shall be entitled to terminate the agreement at once.

　　乙方未履行，未遵守或未完成本協(xié)議規(guī)定的任何約定及義務(wù)，而且在收到甲方通知后，不立即糾正違約，甲方有權(quán)立即終止協(xié)議。

　　汽車租賃合同簽訂注意事項(xiàng)：

　　一、租車前要審查汽車租賃公司的資質(zhì)情況。

　　汽車租賃公司必須有法人營業(yè)執(zhí)照和道路運(yùn)輸許可證，很多汽車租賃公司沒有這兩個(gè)證書，租車人在租車前首先要檢查汽車租賃公司的資質(zhì)情況，否則常常會(huì)出現(xiàn)汽車租賃公司欺詐消費(fèi)者的情況。

　　二、了解車的日限公里數(shù)和超出限數(shù)后的計(jì)費(fèi)標(biāo)準(zhǔn)。

　　三、在租賃前務(wù)必詳細(xì)了解車損情況、第三者責(zé)任和盜搶等條款細(xì)節(jié)。

　　租賃的汽車正常情況下投保四種基本險(xiǎn)，包括交強(qiáng)險(xiǎn)、盜搶險(xiǎn)、車損險(xiǎn)和第三者責(zé)任險(xiǎn)。但有一些租賃公司為了降低成本，往往在僥幸心理的驅(qū)使下只投保交強(qiáng)險(xiǎn)，出了事故后，租車人很有可能面臨承擔(dān)賠償?shù)娘L(fēng)險(xiǎn)。所以，在租車時(shí)，要問清楚車輛的投保情況和合同的附加條款，對(duì)約定不明尤其是責(zé)任約定不明的，要加入附加條款，保障自己的權(quán)益。

　　四、為避免因租車人原因不能及時(shí)還車，導(dǎo)致與租車公司發(fā)生爭議，租車人還應(yīng)認(rèn)真了解續(xù)租規(guī)定及租賃超時(shí)的計(jì)費(fèi)規(guī)定。

　　五、了解租賃公司的承諾，以充分享受各項(xiàng)應(yīng)得的權(quán)利。

　　六、簽訂合同的最后一項(xiàng)內(nèi)容是填寫驗(yàn)車單，這是雙方共同認(rèn)定車況的過程。

　　此過程涉及到還車時(shí)的再認(rèn)定，因此一定要認(rèn)真對(duì)待。首先要從外觀上對(duì)車輛進(jìn)行檢查，例如車體有無劃痕、車燈是否完整、車鎖是否正常等。然后檢查車輛備胎及更換備胎所需的工具，最后進(jìn)入駕駛室內(nèi)，檢查油表、剎車、空調(diào)的運(yùn)行狀況，并進(jìn)行試駕，判斷車輛的基本狀況。對(duì)于一些車型的特殊功能及用法，應(yīng)向租賃公司咨詢清楚。
